The site is owned and operated by Grady's Cold Brew. 1. Your gradyscoldbrew.com Account
You agree that you are responsible for all purchases made through your gradyscoldbrew.com account and for keeping your account credentials secure. You also agree to notify Grady's Cold Brew immediately if you suspect any unauthorized access or security breach related to your account.
2. Content Posted on Other Websites
We have not reviewed all content linked to or from gradyscoldbrew.com. We do not control external websites and are not responsible for their content or use. By linking to a third-party website, Grady’s Cold Brew does not imply endorsement. You should take precautions to protect yourself from harmful or destructive content.
3. Copyright Infringement and DMCA Policy
Grady's Cold Brew respects intellectual property rights and asks others to do the same. If you believe content on our website violates your copyright, please notify us in accordance with our DMCA Policy. We will respond to valid claims by removing or disabling access to infringing material.

6. Termination
Grady’s Cold Brew may terminate your access to the Website at any time, with or without notice. If you wish to terminate your account, you may do so by discontinuing use of the Website. Provisions related to intellectual property, warranties, liability, indemnification, and dispute resolution will survive termination.
7. Disclaimer of Warranties
The Website is provided “as is.” Grady’s Cold Brew disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the site will be error-free or continuously available.
8. Limitation of Liability
In no event shall Grady’s Cold Brew or its suppliers be liable for:

(ii) the cost of substitute products or services;
(iii) or amounts exceeding the fees paid by you to Grady’s Cold Brew.
We are not responsible for delays or failures due to circumstances beyond our control.
9. Coffee Return Policy
Due to the perishable nature of our coffee products, we do not accept returns. However, we want to make it right. If there’s a problem with your coffee, please contact us at customerservice@gradyscoldbrew.com within 2 days of delivery.
10. Return Policy – Merchandise (Non-Coffee Items)
We accept returns or exchanges for non-coffee merchandise within 30 days of purchase. Items must be returned to our headquarters (not to café locations).
Email your order number, name, and reason for return/exchange to customerservice@gradyscoldbrew.com. Return shipping is not refunded. Send non-coffee returns to:

11. Mobile Terms of Service
By signing up for text message communications, you agree to our Mobile Terms of Service.
12. Payment Security
Grady’s Cold Brew does not store sensitive credit card data. All transactions are securely processed and encrypted by a PCI-compliant third-party processor. Our staff cannot access your payment information at any point.
13. Dispute Resolution
If you have an issue with your purchase or experience, please contact our Customer Experience team at customerservice@gradyscoldbrew.com. Most problems can be resolved quickly and informally.
If we can’t resolve it, you and Grady’s Cold Brew agree to resolve any disputes through binding arbitration rather than in court—except for claims eligible for small claims court or misuse of intellectual property.
Arbitration will be conducted by a neutral provider (like JAMS or AAA) under its rules. Unless otherwise agreed, the arbitration will take place in New York, NY, or virtually.
Each party is responsible for its own legal fees unless the arbitrator decides otherwise.
Class Action Waiver: Disputes must be resolved individually—not as part of a class or group action.
Governing Law: These terms follow New York State law, regardless of your location.
Preserving Your Rights: This does not prevent you from reporting issues to government agencies or pursuing claims that can’t legally be forced into arbitration.
14. Indemnification
You agree to indemnify and hold harmless Grady’s Cold Brew and its affiliates, employees, and partners from any claims, losses, or legal expenses resulting from your use of the Website or your violation of this Agreement.
15. Miscellaneous
This Agreement is the full agreement between you and Grady’s Cold Brew. Any legal matters will be governed by the laws of the State of New York, and any disputes must be resolved in courts located in Albany, New York, unless otherwise required by law.
